Privacy Policy

1. Purpose

Active Refrigeration Limited and its related companies (“we”,”us”, “our”) respect your privacy and value the information you share with us. Our Privacy Policy explains how we collect, store, use and disclose any personal information that you provide to us when using this website.

2. WHAT personal information do we collect

We do not collect personal information on our website or from you unless you choose to give it to us. We obtain such personal  information if you choose to disclose your contact details through the contact us portal or if you interact with us otherwise. We do not collect identifiable or personal information about you if you only browse our website.

The personal information we collect from you directly may include:

  • Your identity, including your name;
  • Your contact details, including your email address and contact phone number;
  • Your nearest Active Refrigeration store location; and
  • Account and payment information, which may include bank and credit card details, and for credit account customers, information about your entity and credit history.

We may collect certain information through automated technology about your visit to our website in order to analyse how our website is being used, to monitor and improve performance and to maintain security and functionality. If information is collected through our website, we collect this information using small files called “cookies” and related technology. This digital information we collect may
include:

  • Your IP address;
  • Search terms;
  • Pages you access on our website and the links you click on;
  • The date and time of your visit;
  • The website that directed you to our website, if any;
  • Your approximate location;
  • Your operating system (e.g. Windows, Mac); and
  • The type of web browser you use (e.g. Explorer, Chrome, Firefox).

We may also collect personal information about you from third parties. We will only do this if you have agreed to this first, where permitted by law or where you have authorised another agency to share that information.

In particular, we may collect personal information about you from third parties in the following ways:

  • Credit reporters – If you apply for a credit account with us, we may collect credit information about you with your consent. This information helps us to assess your application for credit;
  • Publicly available sources – including from agencies such as the Companies Office, NZBN Register, internet search platforms and social media platforms, such as Facebook and Linkedin; and
  • Anyone sharing information with us to help us manage loss prevention, retail crime and public safety. This may include other retailers and law enforcement agencies.

3. WHEN and WHY we collect your personal information

We will collect your personal information when you provide information directly to us through our website or if you otherwise interact with us.

We only collect your personal information when you have disclosed it to us and it is necessary for the
specific purpose you have connected with us for.

We primarily use the personal information we collect about you to ensure that you receive the best
service from us, including:

  • To communicate with you regarding your orders, enquiries, or service requests;
  • To improve our website and services;
  • To comply with our legal obligations; and
  • To onboard you as a customer and approve your application for credit (if applicable).

4. HOW we store, use and protect your personal information

4.1 Storage and retention
We retain your personal information only for as long we need it to perform our contractual obligations or meet our legitimate interests, or to comply with our legal obligations.

4.2 Use
We take reasonable steps to ensure that your personal information provided to us is used only in order for us to respond to your query or to carry out the service you require from us.

4.3 Security
We take reasonable steps to ensure that your personal information is protected against loss or unauthorised access, modification, use or disclosure, including:

  • Our systems are protected by firewalls, modern encryption standards and password protected;
  • Access to the personal information we store is limited to those staff members who have a legitimate business requirement to use it; and
  • Information is backed up daily.

5. Accessing and controlling your personal information

You have some important privacy rights, including the right to know what information we hold about you and the right to correct any information that we hold that you believe is inaccurate.

Please note that we need to take steps to make sure you are authorised to make requests about personal information, so we may need to verify your identity or authority before responding to your request. Once we’ve verified who you are, we will try and respond to your request or query as soon possible, and no later than 20 working days after we receive it.

5.1 Getting a copy of your information
You have the right to request a copy of your personal information that we hold for you. If we need to withhold information, we will explain our reasoning to you. To make a request about your personal information please make a request through our website or
contact one of our team directly.

5.2 Correcting your information
If you think any of the personal information we hold about you is incorrect, you can ask us to correct it. If we cannot correct your information (for example, where we don’t agree that it’s wrong), we will explain our reasoning to you. You can ask us to attach your correction request to the information as a statement of correction.

6. Updates to Privacy Policy

We reserve the right to update or revise this Privacy Policy at any time to reflect changes to our business, products or services or changes to the Privacy Act. We’ll update the Privacy Policy on our website, but may not otherwise notify our customers of a change, so please make sure you review it periodically to ensure you’re up to date with our privacy practices.

7. Limitation of Liability

Although we implement reasonable security measures to protect your personal information, by accessing our website or by interacting with us you acknowledge that there is the risk of unauthorised access to or alteration of your transmissions or data or information contained on your computer system or on our website. We do not accept any responsibility or liability of any nature for any losses
that you sustain as a result of such unauthorised access or alteration.

8. Making a complaint

If you have any concerns about the way we have collected or processed your personal information, let us know, so we can try to put the matter right. If we can’t resolve your concerns, you can also make a complaint to the Office of the New Zealand Privacy Commissioner by:

  • Completing an online complaint form at www.privacy.org.nz; or
  • Writing to the Office of the Privacy Commissioner, PO Box 10-094, The Terrace, Wellington 6143, New Zealand.
